These Terms and Conditions ("Agreement") constitute a legal agreement between you ("User", "Customer", "You") and DrivBots ("Company", "We", "Our", "Us"), governing the use of our platform and all related services, including our automated trading bots, subscription services, support features, and any other tools, APIs, or products offered by DrivBots. By accessing or using our website, services, and related content (the "Services"), you agree to comply with and be bound by the terms of this Agreement. If you do not agree to these Terms, you must refrain from using or accessing the Services immediately.

1. Definitions

• DrivBots: The platform, website, tools, AI trading bots, subscription services, and all associated products offered by DrivBots.
• User: Any individual or entity that accesses or uses DrivBots' Services, including but not limited to customers, clients, and site visitors.
• Platform: The website, application, and any digital assets, APIs, or services provided by DrivBots, which includes all updates, upgrades, tools, and systems made available through the platform.
• Account: The personal user account created on the DrivBots platform for the purpose of accessing our Services, tracking trading data, and managing bot settings.
• Subscription Fees: Periodic payments made by you to DrivBots for continued access to our platform, with pricing tiers (such as Basic, Advanced, and Enterprise plans) specified on the platform.
• Content: Any text, graphics, logos, software, or data provided by DrivBots or contributed by you or other users.

2. Acceptance of Terms

By registering, accessing, or using DrivBots' Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you are under 18 or are not of legal age in your jurisdiction, you are not permitted to use the Services. These Terms apply to all Users, whether you are simply browsing our website or fully engaging with our automated trading services. DrivBots reserves the right to modify these Terms at any time and will post updated Terms on this page. You are encouraged to periodically review these Terms to stay informed of changes.

3. Services Provided by DrivBots

DrivBots offers a range of services, including but not limited to the following:

• Automated Trading Bots: DrivBots provides AI-driven bots that facilitate automated cryptocurrency trading on exchanges like Binance, helping users manage trades based on market conditions.
• Trading Analytics: We provide real-time performance tracking and reports to assist users in understanding their trades' outcomes, including profits and losses.
• Customizable Bots: Users can customize bot behavior, set risk tolerance levels, and control trading strategies based on their preferences.
• Integration with Exchanges: DrivBots integrates with third-party cryptocurrency exchanges (such as Binance) using API keys for seamless trade execution.
• Subscription Tiers: We offer multiple subscription plans, with differing features and access levels. These plans include support for both beginners and advanced traders.
• Customer Support: DrivBots provides customer service via email, live chat, and phone (where applicable) to assist users with troubleshooting, setting up bots, and general inquiries.

DrivBots provides software tools for automated trading management and does not directly execute trades or hold user funds. All transactions occur through third-party exchanges connected via user-provided API keys.

DrivBots is committed to providing the best services possible, but does not guarantee any specific performance, profit, or outcome from the use of our Services.

4. User Obligations and Responsibilities

You agree to:

• Accurate Information: Provide true, accurate, and complete information when registering for an account or using any of our Services. This includes your identity, email address, payment information, and any other requested details.
• Compliance with Laws: Abide by all applicable laws, rules, and regulations, including those pertaining to cryptocurrency trading, financial transactions, and data protection.
• No Unlawful Use: You will not use DrivBots for any unlawful or fraudulent activity, including but not limited to market manipulation, hacking, phishing, or any illegal trading activities.
• Respect for Security: Take all necessary steps to secure your account, including using strong passwords and enabling two-factor authentication (2FA) where available.
• Non-transferability: Your account and any associated services are not transferable or assignable to any third party without prior written consent from DrivBots.

5. Compliance and Anti–Money Laundering (AML) Policy

DrivBots is committed to complying with applicable laws and regulations relating to Anti–Money Laundering (AML), Counter–Terrorist Financing (CTF), and fraud prevention. We strictly prohibit and do not tolerate any use of our Services for unlawful purposes, including but not limited to money laundering, terrorism financing, fraud, or other illegal financial activities.

Users agree that they will not use DrivBots to conceal or disguise the origin of funds derived from illegal activities or to facilitate any transaction that could violate any applicable law or regulation.

To ensure compliance with AML and CTF obligations, DrivBots reserves the right to:

• Request identity verification and documentation from Users when deemed necessary;
• Monitor and review account activity to identify suspicious or prohibited behavior;
• Report any suspicious activity to relevant authorities as required by law; and
• Freeze or terminate accounts without notice if we suspect non-compliance with AML or CTF regulations.

By using DrivBots, you acknowledge and consent that your activity may be subject to monitoring and reporting under applicable AML laws, and that DrivBots may cooperate fully with law enforcement or regulatory agencies in such investigations.

6. Know Your Customer (KYC) and Account Verification

To enhance security, prevent fraud, and comply with financial regulations, DrivBots may, at its discretion, require Users to complete a Know Your Customer (KYC) process. This verification may include providing identification documents such as government-issued IDs, proof of residence, and other relevant information.

DrivBots reserves the right to request KYC verification at any time before or after an account is created, as a condition for continued access to the Services. Failure to provide accurate and verifiable information may result in suspension or termination of your account.

DrivBots may use third-party service providers to perform identity verification and risk assessments, and you authorize us to share necessary information with these providers solely for the purpose of compliance with applicable laws and internal risk management.

7. Account Security

You are solely responsible for the security of your account. DrivBots takes the privacy and security of your data seriously and implements industry-standard measures to protect it. However, you are responsible for:

• Protecting Credentials: Keeping your login information and credentials confidential. You agree to notify DrivBots immediately if you suspect any unauthorized access to your account.
• Two-Factor Authentication (2FA): Enabling 2FA to add an extra layer of security to your account. We strongly recommend using 2FA to prevent unauthorized access.

You are solely responsible for maintaining control over your API keys and exchange connections. DrivBots is not responsible for unauthorized trades or losses resulting from compromised API credentials.

8. Subscription Fees, Billing, and Payment

DrivBots offers subscription-based services, with payments required either on a monthly or annual basis. The subscription plans include access to various features, including trading bots, analytics, and customer support. Payments are non-refundable.

• Pricing: Subscription fees are listed on our website and are subject to change. DrivBots reserves the right to change the subscription fees at any time, with notice provided to users.
• Payment Processing: Payments are processed via third-party services (e.g., Stripe, PayPal) and you agree to comply with their terms of service. You authorize us to charge your payment method at the beginning of each billing cycle.
• Late Payments: If a payment fails or is declined, we may suspend or terminate your account until the payment issue is resolved.

9. Trading Risks

Cryptocurrency trading involves significant risks, including the risk of losing some or all of your invested capital. You acknowledge that:

• Volatility: The cryptocurrency market is highly volatile, and market conditions can change rapidly, leading to unpredictable outcomes.
• No Guarantee of Success: DrivBots does not guarantee any specific trading results, profits, or financial outcomes. The performance of trading bots depends on market conditions, which are beyond our control.
• Full Responsibility: You are solely responsible for your trading decisions and strategies, and DrivBots is not liable for any losses, damages, or financial harm resulting from your use of our platform.

No Financial Advice

DrivBots, its owners, and affiliates are not financial advisors. The tools, bots, and information provided are for educational and informational purposes only. Nothing on the platform constitutes financial, investment, or trading advice. All trading decisions are made at your own risk.

You agree to trade at your own risk and to use DrivBots' services only with funds you can afford to lose.

10. Limitation of Liability

To the maximum extent permitted by applicable law, DrivBots is not liable for any loss, damages, or expenses arising from the use of our platform. This includes, but is not limited to:

• Indirect and Consequential Damages: We are not liable for any indirect, special, incidental, or consequential damages arising from your use or inability to use the platform.
• Data Loss: DrivBots is not responsible for any loss of data, loss of profits, or loss of reputation that may occur while using the platform.
• No Warranties: The platform is provided "as is," and DrivBots makes no warranties, express or implied, regarding the accuracy, reliability, or effectiveness of the services provided.

Maximum Liability

To the fullest extent permitted by law, DrivBots’ total liability for any claim shall not exceed the total amount paid by you to DrivBots during the six (6) months preceding the event giving rise to the claim. DrivBots is not responsible for losses arising from third-party platforms, market volatility, or technical errors.

11. Third-Party Services

DrivBots integrates with third-party platforms such as Binance and 3Commas. We do not control these services and are not responsible for their availability, accuracy, or performance. Any disruptions, API changes, or errors from third parties are outside of DrivBots’ control and liability.

These integrations are provided solely for user convenience. You acknowledge that your relationship with third-party platforms is governed by their own terms, not DrivBots’.

12. Data Privacy and Security

DrivBots respects your privacy and is committed to protecting your personal data in accordance with our Privacy Policy. By using DrivBots, you agree to the following:

• Data Collection: We collect personal data, transaction data, and usage data to provide and improve our services. This data may include your name, email address, account information, IP address, and payment details.
• Data Sharing: We do not share your personal information with third parties unless necessary for the provision of services or as required by law.
• Data Protection: We implement various security measures to protect your data, but you acknowledge that no data transmission over the internet can be 100% secure.

You agree that DrivBots may process and store your data as outlined in our Privacy Policy.

13. Intellectual Property

All intellectual property rights associated with the DrivBots platform, including but not limited to logos, trademarks, designs, software, content, and features, are owned by DrivBots. You are granted a limited, non-exclusive, non-transferable license to use the platform according to the terms outlined in this Agreement.

• Prohibited Actions: You agree not to copy, modify, reverse-engineer, or otherwise use any of DrivBots' intellectual property without prior written consent.
• Ownership: All content provided by DrivBots remains our exclusive property. Any unauthorized use of our intellectual property is strictly prohibited and may result in legal action.

14. Termination and Suspension

DrivBots reserves the right to suspend or terminate your account at our discretion if we suspect fraud, breach of these Terms, or illegal activity. We may also suspend or terminate your account if payment is not received or if you violate the platform's usage policies.

Upon termination, you will lose access to your account and all associated services, including any data and trading bots. No refunds will be provided for terminated accounts.

DrivBots also reserves the right to terminate any account without cause or prior notice at its sole discretion.

15. Indemnification

You agree to indemnify, defend, and hold harmless DrivBots, its affiliates, employees, and partners from any claims, damages, liabilities, or expenses arising from your use of the Services, breach of these Terms, or violation of any applicable laws.

16. Force Majeure

DrivBots shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, internet failures, cyberattacks, government restrictions, or third-party API outages.

17. Regulatory Change Disclaimer

Cryptocurrency laws and regulations are evolving rapidly across different jurisdictions. DrivBots operates as a software service provider and does not engage in financial advisory or brokerage activities.

In the event of any regulatory change, introduction of new laws, or interpretation of existing laws that impact the operation of cryptocurrency services or automated trading, DrivBots reserves the right to:

• Modify or restrict certain features or functionalities;
• Suspend or terminate services in affected regions; or
• Update these Terms and related policies to ensure full compliance.

DrivBots shall not be held liable for any losses, limitations, or interruptions of service resulting from compliance with regulatory changes, government actions, or new legal obligations.

Users are solely responsible for ensuring that their use of the platform complies with local laws and regulations applicable in their jurisdiction.

18. Refund Policy

All payments made to DrivBots are non-refundable unless otherwise required by applicable law. Refund requests based on trading losses, user errors, or market performance will not be honored.

By purchasing a subscription, you acknowledge that all payments are final and waive any right to chargebacks or payment reversals except where required by applicable law.

19. Governing Law, Dispute Resolution, and Consumer Rights

‍Governing Law.
These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict-of-law rules.

Arbitration.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or your relationship with DrivBots shall be finally settled by binding arbitration administered by the Arbitration Institute of the Stockholm Chamber of Commerce (SCC).
The seat of arbitration shall be Stockholm, Sweden.
The language of the arbitration shall be English.
Each party shall bear its own legal costs and fees, except as otherwise provided under the SCC Rules or applicable law.
The arbitral award shall be final and binding on the parties.

Class-Action Waiver.
YOU AND DRIVBOTS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS WITHOUT THE WRITTEN CONSENT OF ALL PARTIES.

Injunctive Relief.
Either party may seek temporary, preliminary, or permanent injunctive or equitable relief in the courts of Stockholm, Sweden, to protect confidential information or intellectual-property rights pending final resolution in arbitration.

Consumers (EU/EEA).
If you are a consumer resident in the EU or EEA, nothing in these Terms affects your mandatory statutory rights under applicable consumer law. Where any provision of these Terms (including arbitration, class-action waiver, governing law, venue, or refund clauses) conflicts with mandatory consumer legislation, that provision shall apply only to the extent permitted by law. If mandatory law grants you the right to bring claims before your local courts, you may do so.

Right of Withdrawal for EU/EEA Consumers.
If you are a consumer within the EU or EEA, you may have a statutory 14-day right of withdrawal for digital services. By requesting immediate access to your DrivBots subscription and agreeing that service performance begins immediately, you expressly consent to early performance and acknowledge that you lose the right of withdrawal once the service has been fully performed. If you cancel within the withdrawal period before performance begins, you may owe a proportionate fee for services already provided.

Mandatory Carve-Outs.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, willful misconduct, gross negligence, or any liability that cannot be excluded under applicable law.
